SimpleInviteStart an invite

Terms of service

These terms are the agreement between you and Bangarang Apps, Inc. for the use of SimpleInvite. They bind hosts: people who open an account and send invitations. A guest answering an invite is not party to them.

1. The agreement

SimpleInvite is operated by Bangarang Apps, Inc., a corporation formed in Delaware, United States. By creating an account or sending an invitation you accept these terms. If you do not accept them, do not use the service.

You must be 18 or older to open a host account, and the email address you give us must reach you.

Two other documents go with these terms and are part of the same agreement: the privacy policy at simpleinvite.app/privacy, which says what we hold and for how long, and the SMS terms at simpleinvite.app/sms-terms, which cover texting specifically.

2. The people you invite

This clause matters more than the rest, so it comes first.

Adding someone to an event tells us three things, and you must be able to stand behind all three:

  • You know this person.
  • They have given you permission to send them an invitation from you through SimpleInvite, at the number or address you gave us.
  • That number or address is theirs, and you typed or pasted it correctly.

3. Not a mailing tool

SimpleInvite invites people you know to something you are hosting. It does not reach a purchased list, a customer list, a list of people who once filled in a form, or anyone who has not agreed to hear from you.

You may not use SimpleInvite for promotional messages, sales outreach, newsletters, fundraising appeals to strangers, political messaging, or anything else whose purpose is reaching people in bulk rather than inviting people you know.

If what you are about to send would read as an advertisement to the person who gets it, it does not belong here.

4. Acceptable use

You agree not to use SimpleInvite to:

  • Send anything unlawful, threatening, harassing, defamatory or hateful.
  • Impersonate another person, or send invitations that look as though they came from someone else.
  • Send to anyone who has told you, or told us, to stop.
  • Upload a photo you have no right to use, or one showing a person who has not agreed to it.
  • Work around a limit, a cap or an opt-out, including by spreading one event across several accounts.
  • Probe, scrape, overload or try to break the service or the systems it runs on.
  • Resell the service, or run it on someone else's behalf as an agency without telling us.

5. Your account

You are responsible for what happens under your account, including what a co-host does on an event you own. Keep control of the email address you sign in with: anyone who reaches it reaches your account.

If you think someone else has got into your account, write to help@simpleinvite.app.

6. What we do, and what we do not promise

We send the invitations, reminders and updates you ask for, record the answers that come back, and show you the count.

We report what we saw, not what we hoped. An invitation we sent is marked sent; it is marked delivered only once the provider tells us it arrived. An email provider or a mobile carrier can delay, filter or block a message, and none of that is ours to control.

Limits cap how much goes out per event, per day and per account, so the service stays deliverable for everyone. We tell you when you reach one. We may raise or lower a limit on a particular account, depending on how it is being used.

We may change a feature, add one, or withdraw one. Where a change removes something hosts rely on, we tell them before it happens.

7. Paying

The pricing page is part of these terms. An event with up to 30 guests is free. There are two ways to go above that, and you choose which:

  • One event: $5, charged once, for that event.
  • A year: $39, covering every event you send for twelve months from the day you buy it.
  • Either way, one event can carry at most 150 guests. That is a ceiling, not a price tier: no payment raises it.
  • A repeating event above 30 guests needs the year rather than a single-event payment, because it sends more than one event.
  • The year includes 150 texts a month. Texts beyond that wait for the next month; your invitations still go by email.

8. The money itself

You are never charged before your first send on an event, and a free event never moves onto a paid tier after it has gone out.

Stripe takes the payment. Prices are in US dollars and exclude any tax that applies where you are. If tax applies, it is added at the point of payment.

The year does not renew itself. Nothing is stored to charge you again and no subscription is created — when the twelve months end, you decide whether to buy another year. We email you before the end so it is not a surprise.

If you buy the year within 30 days of paying for single events, what you paid for those events comes off the price of the year, up to the whole of it.

When the year ends, everything you have already sent keeps working. What stops is sending a new event above 30 guests without paying for it.

Refunds: if you cancel an event, if something on our side stopped your invitations going out, or if you bought the wrong thing, write to help@simpleinvite.app and we refund it. We do not run a fixed refund window and we do not require a reason. A refunded year takes back the time it added, so the twelve months end where they would have without it.

A paid event we close for our own reasons is refunded. A paid event closed for a breach of these terms is not.

9. Keys, webhooks and the API

You can create an API key and drive your own events through our interface, and you can give us an address to notify when an answer changes. Both are documented on the developers page, which is part of these terms where you use them.

A key acts as you. Anything done with it is done under your account and section 5 applies to it in full, so keep it as you would keep a password, and delete a key you no longer use. Tell us at help@simpleinvite.app if one gets out.

Where you send your guests' answers to an address of your own, you decide what happens to them after they leave us, and our privacy policy stops at that boundary. Section 2 still applies to everything that goes in: an event created through the interface is an event you are answerable for, exactly as one made on screen.

Rate limits apply, and we may change them. We may also change or withdraw part of the interface; where a change breaks something you are relying on, we tell you before it happens.

10. What you upload stays yours

Your events, your guest list, your notes and your photos are yours. You give us permission to store them, render them into invitations and posters, and send them to the people you invited. That is the service, and we do nothing beyond it.

We do not use your photos or your guest list to promote SimpleInvite. If we ever want to show something of yours, we ask first.

11. Ending it

Delete your account from settings whenever you like. We mark it deleted, cancel any live event — everyone who said yes is told it is off — and stop every scheduled message. The privacy policy says what happens to the data after that.

We can suspend or close an account that breaks these terms, that draws enough opt-outs or complaints to threaten delivery for other hosts, or that is being used for the bulk sending section 3 forbids. Where we can, we tell you first and give you a chance to put it right. Where a suspension has to be immediate to protect other people, we act first and explain afterwards.

What happens to money on the way out is in section 8.

12. Disclaimers

The service is provided as it is. We do not warrant that it will run uninterrupted, that every message will arrive, or that it will be free of faults. So far as the law allows, we exclude the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Your event is yours. We do not host it, run it or take part in it, and we are not answerable for what happens there or for how the people you invited behave.

13. Limitation of liability

So far as the law allows, Bangarang Apps, Inc. is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data or the cost of replacement services, arising from your use of SimpleInvite.

Our total liability for any claim about the service is capped at the greater of what you paid us in the 12 months before the claim, or one hundred US dollars.

Some places do not allow these exclusions. Where that is so, they apply to you only as far as the law permits.

14. Your responsibility for what you send

If someone brings a claim against us over the messages you sent, the people you added or the content you uploaded, you agree to defend us against it and to cover what it costs us, including reasonable legal fees.

That is the other side of section 2. We carry the invitations. You decide who gets them.

15. Changes to these terms

We may change these terms. The effective date at the top changes with them, and we email hosts before a material change takes effect. Using SimpleInvite after that date means the new terms apply to you.

16. Governing law

These terms are governed by the laws of the State of Delaware, United States, setting aside its conflict-of-laws rules. A dispute we cannot settle between us goes to the state or federal courts in Delaware, and we each agree to that venue.

17. The rest of it

The ordinary provisions, stated rather than left out:

  • These terms, the privacy policy, the SMS terms and the pricing page are the whole agreement between us about SimpleInvite, and they replace anything said before.
  • If one part of them is held unenforceable, the rest still stands and that part is read as narrowly as it has to be.
  • Not enforcing something once does not give it up for good.
  • You may not transfer your rights under these terms to anyone else. We may transfer ours if the business is sold or reorganized, and we tell hosts when that happens.
  • Neither of us is answerable for a failure caused by something genuinely outside our control — an outage at a provider we depend on, a carrier blocking traffic, a natural disaster.
  • Notice to you is the email address on your account, so keep it one that reaches you. Notice to us is help@simpleinvite.app.
  • Sections 2, 10, 12, 13 and 14 survive the end of this agreement, because the things they cover outlast the account.
  • If you believe something on SimpleInvite infringes your copyright, write to help@simpleinvite.app with enough detail to find it, and we will take it down where the claim holds up.
  • You may not use SimpleInvite where US sanctions or export law forbid it.
